Privacy Policy

1. Introduction

FuelX (Pty) Ltd (“we”, “us”, or “our”) provides Attendly, a workforce time-tracking application that lets employees clock in and out of work and produces timesheets for their employer. This Privacy Policy explains what personal information we collect through the Attendly mobile app and website, how we use it, who we share it with, and the choices and rights you have.

Attendly is sold to organisations (such as your employer) on a subscription basis, and those organisations provide access to the app to their employees. In most cases your employer is the controller of the personal information processed about you, and we act as a processor handling that information on their behalf and under their instructions. For our own website and account records, we act as the controller.

2. Information we collect

We collect the following categories of information:

  • Account information. Your name, email address, and the organisation you belong to.
  • Third-party sign-in information. If you sign in with Google, we receive your Google account identifier, name, email address, and profile picture, and we use them only to create and authenticate your Attendly account. We do not use Google account data for advertising, and we do not share it with others except as described in Section 5. If you sign in with Apple, we receive the identifier (and, if you allow it, the name and email) that Apple shares with us, and use it for the same purpose. Our use of information received from Google APIs adheres to the Google API Services User Data Policy, including its Limited Use requirements.
  • Attendance and timesheet data. Clock-in and clock-out times, shift durations, overtime, and the workplace locations associated with those events.
  • Location information.With your permission, we collect your device’s geographic location — including in the background while a shift is active — so we can automatically clock you in and out when you enter or leave a designated workplace and confirm that shifts were logged at the correct site. Location is used only for these attendance features. You can disable location access at any time in your device settings (see Section 7).
  • Device and usage information. Basic technical data such as device type, operating system, app version, and log information generated when you use the app, used to operate, secure, and troubleshoot the service.

We do not knowingly collect information from children. Attendly is intended for use by employees in a workplace and is not directed to anyone under 16.

3. How we use your information

We use personal information to:

  • Provide, maintain, and secure the Attendly service;
  • Record attendance, calculate hours and overtime, and generate timesheets for your organisation;
  • Automatically clock you in and out based on your location at a designated workplace;
  • Authenticate you and manage your account;
  • Respond to support requests and communicate with you about the service; and
  • Comply with legal obligations and enforce our terms and policies.

Where we act as a processor, we handle attendance and location data only to deliver the service to your organisation and on their instructions. We do not sell your personal information, and we do not use it for advertising.

4. Legal bases for processing

Where the EU/UK General Data Protection Regulation applies, we rely on the following legal bases: performance of a contract (to provide the service); your consent (for device location access, which you can withdraw at any time); our and your organisation’s legitimate interests (to operate, secure, and improve the service and to record time worked); and compliance with legal obligations.

5. How we share information

We share personal information only as described below:

  • With your organisation. Your employer and its authorised administrators can access your account, attendance, and timesheet data through Attendly.
  • Service providers. We use trusted third parties to host and run the service — for example, cloud hosting and database infrastructure, email delivery, and, for automatic clock-in, mapping and geolocation services. These providers may process your information only to provide services to us and are bound by confidentiality obligations.
  • Legal and safety. We may disclose information where required by law, to enforce our agreements, or to protect the rights, safety, and security of our users, FuelX (Pty) Ltd, or the public.
  • Business transfers. If we are involved in a merger, acquisition, or sale of assets, personal information may be transferred as part of that transaction.

6. Data retention

We retain personal information for as long as your organisation maintains an active subscription and your account remains active, and thereafter as needed to comply with legal, accounting, or reporting obligations. Attendance and timesheet records may be retained by your organisation to meet employment and payroll record-keeping requirements. When information is no longer needed, we delete or anonymise it.

7. Your choices and rights

You can control location collection at any time through your device’s settings by revoking Attendly’s location permission. Disabling location will turn off automatic clock-in and clock-out but will not otherwise prevent you from using the app.

Depending on where you live, you may have rights to access, correct, delete, or port your personal information, and to object to or restrict certain processing. Because your employer is often the controller of workplace attendance data, please direct requests about that data to your organisation; we will assist them as needed. For information we control, or if you are unsure who to contact, you can reach us using the details in Section 11, and we will respond in accordance with applicable law.

8. Security

We use administrative, technical, and organisational measures designed to protect personal information against unauthorised access, loss, or misuse, including encryption in transit and access controls. No method of transmission or storage is completely secure, so we cannot guarantee absolute security.

9. International transfers

We and our service providers may process and store information in countries other than the one in which you live. Where we transfer personal information across borders, we take steps to ensure it receives an adequate level of protection as required by applicable law.

10. Changes to this policy

We may update this Privacy Policy from time to time. When we make material changes, we will update the “Last updated” date above and, where appropriate, notify you through the app or by email. Your continued use of Attendly after an update means you accept the revised policy.
